Speed decides how much time you have to spot hazards and react. West Virginia sets default limits by road type, but the basic speed law always applies: never drive faster than is reasonable and prudent for current conditions.

Know the rule

Basic speed law: WV prohibits driving faster than is reasonable and prudent for existing conditions, even below the posted limit.

Handbook p. 52 ↗

Slow down when:

  • Approaching and crossing an intersection
  • Approaching and going around a curve
  • Approaching the top of a hill
  • Traveling on a narrow road
  • Traffic, weather or road hazards limit visibility or stopping distance

Know the rule

Authorized emergency vehicles may exceed posted limits on emergency duty with signals operating, as long as other road users aren't endangered.

Handbook p. 52 ↗

Know the rule

When driving slower than normal traffic, keep as close as possible to the right edge of the road.

Handbook p. 53 ↗

Know the rule

On a road with one lane each way and no clear lane for passing, if you must drive slower than the designated speed, pull off at the first safe turnout to let faster traffic pass.

Handbook p. 53 ↗

Put it into practice

It's 7:45 am and children are walking beside the road near an elementary school on a street normally posted 25 mph. Within 125 feet of the school grounds, you must drive no faster than 15 mph.

On a road with one lane each way, you must drive slower than the designated speed and traffic is backing up. What should you do?
  1. Turn on your hazard lights and keep going
  2. Pull off at the first safe turnout to let traffic pass
  3. Wave traffic around you into the other lane
  4. Speed up to the designated speed

Answer: Pull off at the first safe turnout to let traffic pass

On a road with one lane each way, a slow driver should pull off at the first safe turnout so faster traffic can pass.

Handbook p. 53 ↗
Even when driving under the posted speed limit, you can still violate the basic speed law if conditions call for slower driving.
