Indiana won't let you drive uninsured. If the BMV asks for proof of insurance and you can't provide it, you lose your license and pay to get it back.
Know the rule
You may not drive in Indiana unless financial responsibility is in effect for the vehicle or you are otherwise insured to operate it.
Handbook p. 27 ↗Minimum liability insurance (25/50/25)
| Coverage | Minimum |
|---|---|
| Bodily injury or death of one person | $25,000 |
| Bodily injury or death of 2+ people, one accident | $50,000 |
| Property damage in one accident | $25,000 |
The BMV may ask you to verify insurance after:
- An auto accident
- A pointable moving violation within one year of two other pointable moving violations
- A serious traffic violation, such as a misdemeanor or felony
- Any pointable moving violation by a driver once suspended for not proving insurance
Certificate of Compliance (COC)
Proof, filed electronically by your insurer, that the vehicle you drove was insured to at least 25/50/25 at the time of the incident or accident.
Handbook p. 27 ↗Time after the BMV mails its request for the COC to be received and processed, or you're suspended
Handbook p. 27 ↗Know the rule
If you were driving a company or rental vehicle, your employer or the rental company completes State Form 55434 (Affidavit – Proof of Financial Responsibility for Employer or Rental Vehicles).
Handbook p. 27 ↗Know the rule
If a court convicts you of driving without insurance, contact that court to find out whether proof of insurance can remove the conviction.
Handbook p. 27 ↗SR22
Proof of future financial responsibility, filed electronically by your insurer. It shows a policy meeting state minimums and can't be canceled without prior notice to the BMV.
Handbook p. 28 ↗Know the rule
After a court conviction for driving uninsured or failing to file insurance, you need an SR22 on file to be reinstated. Without one, the suspension continues.
Handbook p. 27 ↗Know the rule
No-insurance suspensions effective on or after 12/31/2021 are indefinite. An SR22 stays the suspension, and keeping the SR22 continuously for 180 days ends it.
Handbook p. 28 ↗Know the rule
If your insurer sends the BMV an SR26 (SR22 cancellation), you're suspended until a new SR22 is filed or the requirement ends. An SR26 during the 180-day stay reactivates the suspension.
Handbook p. 28 ↗No-insurance reinstatement fees
| Suspension | After Jan. 1, 2015 | Before Jan. 1, 2015 |
|---|---|---|
| First | $250 | $150 |
| Second | $500 | $225 |
| Third and subsequent | $1,000 | $300 |
Know the rule
You can avoid the reinstatement fee by having an SR22 filed and keeping it continuously for 180 days. An SR26 during that stay puts the fees back into active status.
Handbook p. 28 ↗Put it into practice
After a fender-bender, the BMV mails you a request to verify insurance. Call your insurer right away and have them electronically file a Certificate of Compliance. If it isn't processed within 90 days of the BMV's mailing, your license is suspended.
