By driving in Oklahoma you've already agreed to be tested for alcohol if an officer asks. Refusing, or testing over the limit, costs you your license through Service Oklahoma, whether or not a court ever convicts you of DUI.
Implied consent
Driving or being in actual physical control of a motor vehicle means you have agreed to take one or more tests of your blood alcohol content (BAC). It applies to residents and non-residents alike.
Handbook p. 65 ↗Know the rule
Refusing the test when a law enforcement officer asks results in automatic revocation of your driving privilege, even if you have not been drinking.
Handbook p. 65 ↗Know the rule
If your BAC is 0.08 or more (or any measurable amount if you're under 21), your license will be revoked, even if you are not convicted in court of DUI.
Handbook p. 65 ↗Revocation under the Implied Consent Law, depending on your previous driving record
Handbook p. 65 ↗Know the rule
Impairment of judgment and skill begins well below the legal limit. The officer's observations are also evidence and can lead to a conviction without a BAC test.
Handbook p. 65 ↗Know the rule
Oklahoma law prohibits driving while impaired by alcohol or other substances. An alcohol concentration of more than 0.05 is relevant evidence that your ability to drive was impaired.
Handbook p. 65 ↗BAC levels
| BAC | Consequence |
|---|---|
| Over 0.05 but less than 0.08 | Impaired: fine $100-$500, up to 6 months jail, or both |
| 0.08 or more | DUI; license revoked |
| Any measurable amount, under 21 | License revoked (Zero Tolerance) |
When Service Oklahoma receives notice of an impaired-driving conviction, it suspends your driving privilege:
- First suspension: 30 days
- Second suspension: 6 months
- Third suspension: 1 year
DUI
"Driving Under the Influence": a driver is intoxicated by drugs or alcohol or both.
Handbook p. 65 ↗Put it into practice
A 25-year-old is stopped and blows 0.06. That's under 0.08, but over 0.05 is evidence of impairment: a conviction for impaired driving means a $100-$500 fine, up to 6 months in jail or both, and a 30-day first suspension.
