Legal limits & license suspension
A 2-minute lesson from the North Dakota course. Read the rules and examples, follow the handbook page references, and check your understanding before you move on.
North Dakota's DUI law has two separate penalties: an administrative license penalty and a court conviction penalty. Your driving privileges can be suspended through either process, or both. The administrative side starts with your test result.
A temporary restricted license can be issued after serving at least 30 days of the suspension, or at least 14 days if you're in the 24/7 Sobriety Program.
The handbook adds: temporary restricted licenses can only be issued if within the past 7 years there has been a refusal or more than one alcohol/drug violation, and the 24/7 Sobriety Program is required until one year violation free.
A 19-year-old is stopped and tests at .03%. That's under .08%, but the limit for drivers under 21 is .02%, so the driver is legally under the influence. A first offense in seven years brings a 91-day suspension.
