Drivers under 21 face a much lower alcohol limit. Drug convictions cost you your license even when no driving was involved. If you're suspended at a DUI stop, the clock to challenge it starts right away.

.02

Know the rule

A driver under 21 stopped with a BAL of .02 or higher automatically loses the driving privilege for six months.

10 days

From the arrest to request a formal or informal review hearing at a BAR office

Handbook p. 39 ↗

Know the rule

To appeal an administrative suspension for a BAL of .08 or above or a test refusal, you must apply for a formal or informal review hearing at the Bureau of Administrative Reviews (BAR) within 10 days of your arrest.

Handbook p. 39 ↗

Know the rule

A first-time DUI offender with no prior DUI offenses may ask, within 10 days of the arrest, for a restricted license. Taking it waives the right to review the suspension, and the fee is non-refundable.

Handbook p. 39 ↗

You may have to complete a licensed DUI program if suspended for:

  • An unlawful blood or breath alcohol level
  • Refusing a breath, blood or urine test
  • A conviction for DUI or for possession of a controlled substance
Handbook p. 26 ↗

Know the rule

If your privilege is suspended or revoked, you may qualify for a hardship license or reinstatement. Ask a BAR office, a service center or the FLHSMV Customer Service Center.

Handbook p. 39 ↗

Put it into practice

You're 19 and had one beer. An officer measures your BAL at .03. That's well under .08, but you're under 21, so you automatically lose your privilege for six months. Reinstating on a hardship basis requires a TLSAE course.
