Drinking and driving penalties in Virginia are severe and start before any trial. Just by driving on public roads you've agreed to a breath test, and refusing or failing one gets your license suspended automatically.

Implied consent

By operating a motor vehicle on Virginia's public roads, you agree to take a breath test upon request.

Handbook p. 32 ↗

Know the rule

If police have probable cause to suspect drinking or drug use, they will ask you to take a breath or blood test.

Handbook p. 32 ↗

  • You show signs you've been drinking

DUI with a juvenile (17 or younger) in the vehicle:

  • Additional mandatory 5-day jail term, plus all other fines and jail
  • Possible additional fine of at least $500 and up to $1,000
  • Second such offense: additional 80 hours of community service
Handbook p. 32 ↗

Put it into practice

It's your second DUI charge and you refuse the breath test. Your license is automatically suspended for 60 days or until your trial, whichever comes first, before any conviction.
