An ignition interlock device (IID) lets many DUI offenders drive again before their revocation ends—but only in vehicles fitted with the device. You pay all the costs, and the device stays on for a set minimum time.

IID license

Limited driving privileges linked to approved vehicle(s) that have an ignition interlock device installed.

First Offense Election (FOE)

A program a first offender may enter instead of standing trial. FOE offenders with a violation on or after Feb. 2, 2015 may apply for an IID license immediately.

Know the rule

IID time runs from the date the IID license is issued, and the device must stay on for the entire required period even if your original revocation would have ended sooner.

Handbook p. 58 ↗

Know the rule

An IID must be installed on every vehicle you will drive during the revocation, whether or not you own it, and you pay all program costs.

Handbook p. 58 ↗

You can't get an IID license if:

  • The offense involved death or serious injury to any person
  • You need it for CDL-class vehicles or endorsements (not available)
  • Your license is suspended, revoked, disqualified or denied for another disqualifying violation
  • You didn't have a valid Delaware license at the time of the offense
Handbook p. 57 ↗

Applying for an IID license:

  • Complete an IID application
  • DMV verifies enrollment in the course/program from your alcohol evaluation; pay its fees
  • Surrender your current Delaware license
  • Prove insurance and valid Delaware registration for each vehicle getting an IID
  • You may need to pass vision, knowledge and road skills tests
  • DMV authorizes an approved vendor to install; after proof of installation, the IID license is issued
Handbook p. 58 ↗

Know the rule

FOE with IID: keep the IID for four months from the IID license date. Before reinstatement DMV needs a satisfactory alcohol program report and a $200.00 fee; an eye screening, law test and road test may be required.

Handbook p. 55 ↗

Know the rule

An FOE offender with no vehicle in their name who skips the IID can't be reinstated until the full revocation period ends, with no driving during it.

Handbook p. 56 ↗

Know the rule

DMV may extend the IID period or remove you from the program for non-compliance. If you don't apply for the IID program, you serve the entire revocation and may not drive.

Handbook p. 58 ↗

Put it into practice

After a second DUI conviction, Sam waits the required 60 days, enrolls in his alcohol program, surrenders his license and has an IID installed in the family car he drives. The IID stays on at least 16 to 28 months, depending on his BAC.
