If you're in a crash and don't pay for the damage, the Safety Responsibility Law can suspend your license. Georgia also revokes licenses for Habitual Violators, drivers who refuse a re-examination, and drivers found unsafe for medical reasons.

Know the rule

The law removes irresponsible drivers from Georgia highways and protects insured motorists from uninsured ones. If you fail to satisfy a crash damage claim and a claim is filed under this law, you'll get a suspension order.

Handbook p. 49 ↗

To avoid the suspension, you may:

  • Have your insurance carrier file Form SR-21, if you had liability insurance at the time of the crash
  • File a general or conditional release signed by the claimant (the injured party)
  • Post security for the damages, plus proof of financial responsibility (Form SR-22A)
Handbook p. 49 ↗

Know the rule

Security may be a cashier's check, certified check, money order, real property bond or surety bond. It's held for one year, and then until you prove you haven't been sued over the crash.

Handbook p. 49 ↗
10 days

Request a hearing within this time of receiving the suspension order

Handbook p. 49 ↗

Your license will be revoked if:

  • You're declared a Habitual Violator
  • You refuse a re-examination of driving skills or rules after notice with reasonable grounds
  • You're declared incompetent, or found unsafe to drive due to a mental or physical condition
  • You're found unsafe to drive due to alcohol or drug addiction

Revocation a Habitual Violator serves before a probationary license

Put it into practice

You crash into another car while uninsured and don't pay the owner's claim. The owner files under the Safety Responsibility Law, and DDS orders your license suspended. A release signed by the owner, or posted security plus an SR-22A, can prevent it; you have 10 days to ask for a hearing.

Check your understanding

Read the question, decide on an answer, then open it to check the explanation. These are Roadwise study questions based on the source handbook.
